General Terms and Conditions

The following terms and conditions apply to all transactions on www.strictlypens.co.uk. The placing of an order indicates your acceptance of these terms and conditions.

Please read these Term and Conditions very carefully and if necessary print a copy for your future reference. These Terms and Conditions do not affect your statutory rights.

To order goods through this website you must be at least 18 years of age, a UK Resident with a UK Delivery Address. We do not accept International Orders. We will treat each order for goods as an offer by you to purchase the goods subject to these Terms and Conditions.

It is only when we have despatched the goods to you that we have a binding contract.

These Terms & Conditions and any contract between us shall be governed by and interpreted in accordance with English Law and the English Courts shall have jurisdiction over any disputes between us.

Strictly Pens reserves the right to refuse to supply, at our discretion, any goods ordered by you or to cancel an order in its entirety.

Description of Goods

Although Strictly Pens warrant that the goods will, at the time of delivery, correspond to our description on our website, we reserve the right to be able to change the design or modify a product, change its colour and specification as we see fit. Should this happen Strictly Pens will endeavour to up-date our website as soon as possible of these changes and where applicable notify customers of any such changes.

Pricing

All prices quoted by Strictly Pens are in Pounds Sterling (?) and include VAT at the prevailing rate. Delivery charges are extra.

Strictly Pens reserve the right to change the prices listed and to end any promotions without notice. Strictly Pens reserve the right to add or withdraw any item at any time. All orders for products are subject to availability and Strictly Pens reserve the right to refuse to supply to any individual or company.

Although Strictly Pens makes every effort to ensure the prices on the website are correct mistakes may sometimes be made. If Strictly Pens discover a mistake in the price of the goods you have ordered, we will inform you as soon as possible and give you the option of either reconfirming your order at the correct price or cancelling it. If Strictly Pens is unable to contact you, we will treat the order as cancelled. If your order is cancelled and you have already paid for the goods you will receive a full refund. We are under no obligation to supply any product that is priced incorrectly.

Typographical Errors

In the event that a product is listed at an incorrect price due to a typographical error, Strictly Pens shall have the right to refuse or cancel any orders based on the incorrect price whether or not the order has been confirmed.

Product Images / Specifications

Whilst Strictly Pens endeavour to ensure all images and specifications are correct at the time of publication, they do and can vary. Colours as shown in photographs and images may vary slightly from the actual item due to photographic techniques and production variations.

Strictly Pens can accept no responsibility for incorrect images/information. If however you spot a mistake with an image or a product specification please let us know.

Payment

When placing an order with Strictly Pens you must provide us with the exact postal address, including post code and telephone number that your credit card issuer has on file for you. Your order will only be processed once authorisation of your credit card has been properly received.

Availability of Goods

All products are subject to availability and may be withdrawn at any time. If this should occur with your order then it is Strictly Pens policy to contact you and if you do not wish to proceed with the order we will arrange for the order to be cancelled and we will refund your payment.

Delivery and Packing

Normally orders are despatched within 3 working days. However if the product is not in stock it may take longer. Please allow up to 28 days for delivery.

If Strictly Pens is unable to fulfil your order within 28 days, we shall either agree a new timescale with you or you may cancel the order. In which case we will refund in full any payments that you have made.

Orders with a value of ?50 or over are given priority and will be despatched as soon as possible using Royal Mail Special Delivery Service (next day delivery) which will require a signature.

Orders with a value of under ?50 will be sent using Royal Mail Signed-For Service which will require a signature.

Orders for Refills or of a small value under ?10 will be send by Royal Mail 1st Class Delivery with a proof of sending.

All delivery times quoted on this website are estimates only and are based on working days. Strictly Pens shall not be liable to you for any delay or failure to deliver the goods within these estimated timescales.

Strictly Pens delivery charges include packaging, handling and postal costs.

Tracking your order in the Post.

When your order has been dispatched using either Royal Mail Signed-For or Special Delivery Services you will be notified by E-mail of its Tracking Number and you will be able to monitor its progress on the Royal Mail Track & Trace web site.

The above Tracking Facility will not apply to small value orders sent by Royal Mail 1st Class Delivery.

Goods Arrive Damaged or Lost in Transit

Strictly Pens will make sure that all packaging is secure and suitable for despatch. We will also ensure all shipments are correctly labelled. However, in the event of goods arriving damaged or the shipment going missing in the post, the customer must notify Strictly Pens immediately and not later that 24 hours after receipt of any damaged goods. It is imperative that the customer does not dispose of any of the packaging as this will be required to affect a claim against the postal service.

Once you have notified Strictly Pens we will immediately instigate a claim for loss or damage against the Royal Mail Service used and keep you informed at all times. Strictly Pens may require your cooperation in forwarding any damaged goods to either us or to Royal Mail. Strictly Pens cannot be held responsible if the customer does not cooperate with such a request. Under these circumstances the customer's claim for such damage will become void and no compensation will be made to the customer.

Experience has shown that claims made against the Royal Mail can take up to 60 days before they are resolved. Strictly Pens will take one of the following actions regarding compensation to its customers:

EITHER Strictly Pens may replace the item or make a full refund immediately on being notified of any problems. This will be at the discretion of Strictly Pens.

OR ask the Customer to wait until any investigation by Royal Mail is completed and then compensate the Customer in accordance with the result of the Royal Mail investigation.

Incorrect Goods

It is the customer's responsibility to contact Strictly Pens regarding any incorrect goods supplied within 48 hours of delivery. If the items are not as ordered the customer must not open the manufacturers packaging (if the packaging is sealed by the manufacturer) or use the item. The customer will also be required to provide a full description of what was received in error. Strictly Pens will reply to the customer and agree a suitable solution to the problem within 48 hours.

Non-Deliveries

Strictly Pens does not accept liability for goods lost in transit unless we are notified within 5 days from the despatch date. This will be the date advised by E-mail to the customer and on the customers despatch note attached to goods in transit. Strictly Pens shall accept no liability for shortages, non-deliveries, incorrect goods and goods damaged on delivery outside the reported timescales, except where extenuating circumstances have prevented notification within the reported timescale. The extenuating circumstances must be by mutual agreement.

Faulty Goods

If you think that the product you have purchased is faulty, you must contact Strictly Pens upon receipt of goods within 24 hours and report the fault. If Strictly Pens and the manufacturer agree that the product is faulty, in most cases we will be able to authorise a replacement of the product direct to you.

This does not cover any accidental damage to goods after they have been received in good condition. All goods will be inspected prior to shipment to make sure that they are in good condition.

Strictly Pens will take no action until the faulty goods have been returned for inspection.

Refunds

If for any reason you are issued with a refund, please note the following:

- All refunds will be issued to the same payment method as on the original order.

- When a refund is processed you will receive notification.

- A refund will usually reach your credit card account within 14 working days after it has been processed. Please allow up to 14 working days for a credit to arrive on your account.

Strictly Pens does however reserve the right not to refund a customer until we are in mutual agreement regarding the reason and circumstances regarding any such refund.

Returns & Refunds

If you are not happy with any of the goods that you have purchased, return them to Strictly Pens within 14 days and we will give you a full refund for the item, subject to the following conditions:

- The item must be unused and in mint condition with its original packaging and accessories.

- If the item is returned because it is incorrect or faulty, and you do not want a replacement, we will refund the price of the item and any delivery charges. If you return a product for any other reason Strictly Pens will refund the price of the item but not the delivery charges.

- If you are returning an item because you would like to exchange it for a different item then there may be additional postage costs for sending out the exchange of item.

- You must contact Strictly Pens before returning any product so that we can explain how to make the return and give you a return reference number.

Force Majeure

Strictly Pens will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any goods by any reason or cause beyond our control.

This site may contain links to other Third Party websites. These links have been selected by Strictly Pens to offer our customers extra information regarding pen products. However we do not offer any guarantees regarding the products, information or services that they offer and we are not responsible for their operations in any way.

Amendments to Strictly Pens Website

Strictly Pens reserve the right to make changes to our website, policies, and Terms & Conditions. Any changes will be posted on our website. It is your responsibility to check whether the Terms & Conditions have been revised, as use of the Strictly Pens website after the date of any such revision or amendment shall be deemed to constitute your acceptance of the revised Terms & Conditions.

All elements of the website content and all logos, photography, graphics and software are protected by UK copyright laws. You are entitled to view the website and to print pages of the website for the sole purpose of placing an order with Strictly Pens. However, any copying or downloading from the website without written permission from Strictly Pens is prohibited and will be deemed an infringement of copyright.
